Terms and Conditions of the Application Use
By using the ICFSME MOBILE Application, you indicate that you accept the Terms and agree to abide by them. If you disagree with the Terms, please refrain from using the ICFSME MOBILE Application.
Accessing the ICFSME MOBILE Application its Availability, and Amendment
- Access to the ICFSME MOBILE Application is permitted temporarily, and the Company reserves the right to withdraw or amend at its absolute discretion the service it provides on the ICFSME MOBILE Application without notice.
- The Company will not be liable if the ICFSME MOBILE Application is unavailable at any time or for any period.
- From time to time, the Company may restrict access to some parts or all of the ICFSME MOBILE Application.
- The Company aims to update the ICFSME MOBILE Application regularly and may change the content at any time.
- Any of the Materials appearing on the ICFSME MOBILE Application may be out of date at any given time, and the Company is under no obligation to update such Materials.
Intellectual Property Rights
- Unless otherwise stated, the Company is the owner or licensee of all intellectual property rights (including all copyright) in all text, photographs, graphics, and computer code on this application, the overall design of this application, and the selection, arrangement, and presentation of all materials on the ICFSME MOBILE application (collectively the "Materials").
- The Materials are made available for viewing online only. The Materials published on the ICFSME MOBILE Application may not be reproduced, used, stored in an application or other form of electronic retrieval system, or transmitted in any form or by any means, without the express prior written permission of the Company or the permission of the respective right holders.
Reliance on Materials Posted on the ICFSME MOBILE Application by the Company
- Texts and other Materials posted on the ICFSME MOBILE Application are not intended to amount to advice on which reliance should be placed.
- The Company disclaims all liability and responsibility arising from any reliance placed on such Materials by any user of the ICFSME MOBILE Application.
Liability for Materials Posted on the ICFSME MOBILE Application by the Company
- The Materials displayed on the ICFSME MOBILE Application are provided without any guarantees, conditions, or warranties as to their accuracy.
- To the extent permitted by law, the Company, its subsidiaries, and affiliates, hereby expressly exclude:
(a) all conditions, warranties, and other terms which might otherwise be implied by law; and
(b) any liability for any direct, indirect, special, incidental, punitive, consequential, or other damage incurred by any user in connection with the ICFSME MOBILE Application or connection with the use, inability to use, or results of the use of the ICFSME MOBILE Application, any applications linked to it and any materials posted on it, including reproduction of Materials by Clause 4 of these Terms and, without limitation, any liability for:
(i) loss of income or revenue;
(ii) loss of business;
(iii) loss of profits or contracts;
(iv) loss of anticipated savings;
(v) loss of data;
(vi) loss of goodwill;
(vii) wasted management or office time; and
(viii) for any other loss or damage of any kind, however arising and whether caused by extra-contractual civil liability (including negligence), breach of contract or otherwise, even if foreseeable.
Viruses, Hacking, and Other Offences
- You must not misuse the ICFSME MOBILE Application by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.
- You must not attempt to gain unauthorized access to the ICFSME MOBILE Application, the server on which the ICFSME MOBILE Application is stored or any server, computer or database connected to the ICFSME MOBILE Application.
- You must not attack the ICFSME MOBILE Application via a denial-of-service attack or a distributed denial-of service attack.
- The Company will report any such breach to the relevant law enforcement authorities and it will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the ICFSME MOBILE Application will cease immediately.
- The Company will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of the ICFSME MOBILE Application or to your downloading of any material posted on it, or any application linked to it.
Linking to the ICFSME MOBILE Application
- You may link to the home page of the ICFSME MOBILE Application, provided you do so in a way that is fair and legal and does not damage the Company's reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on the Company's part where none exists
- The ICFSME MOBILE must not be framed on any other site.
- You must not establish a link from any application that is not owned by you.
Links from the ICFSME MOBILE Application
- Where the ICFSME MOBILE Application contains links to other applications and resources provided by third parties, these links are provided for your information only.
- The Company has no control over the contents of those applications or resources, and accepts no responsibility for them or for any loss or damage that may arise from your use of them.
Prohibited Uses
You may use the ICFSME MOBILE Application only for lawful purposes. You may not use the ICFSME MOBILE Application:
(a) In any way that breaches any applicable local, national or international law or regulation.
(b) In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
Breach
Failure by you to comply with the Terms may result in the Company taking all or any of the following actions:
(a) suspension of your right to use the ICFSME MOBILE Application;
(b) legal proceedings against you for reimbursement of all costs on an indemnity basis (including but not limited to, reasonable administrative and legal costs) resulting from the breach;
(c) further legal action against you; and/or
(d) disclosure of such information to law enforcement authorities as the Company reasonably feels is necessary or as required by law.
Jurisdiction and Applicable Law
The Iraqi courts shall have jurisdiction over any claim arising from, or related to, the use of the ICFSME MOBILE Application, although the Company retains the right to bring proceedings against you for breach of the Terms in your country of residence or any other relevant country.
Trademark
- " ICFSME Mobile" is a registered trademark owned by the Company.
- The Terms do not constitute a license of the ICFSME MOBILE trademark.
Variations to the Terms
- The Company may revise these Terms of use at any time by amending this page.
- You are expected to check this page from time to time to take notice of any changes the Company makes. Your continued use of the application shall constitute your acceptance of any such changes to these Terms.
